Terms of Service
These Terms govern your use of the Fapaton website and Telegram Mini App (the “Service”). By using the Service you agree to these Terms; if you don’t agree, stop using it.
1. Adult Content & Eligibility
The Service contains adult, explicit material. You confirm you are 18+ (or the age of majority where you live) and that viewing such content is legal for you. We do not knowingly collect data from minors; if discovered, it will be removed and access blocked.
2. No Telegram Affiliation; Hosting
Fapaton is independent of Telegram and is not affiliated with it in any way. Direct any questions or notices to Fapaton, not Telegram.
3. Acceptance of Terms
These Terms apply to anyone accessing the Service via browser or Mini App. Using the Service means you accept these Terms and our Privacy Policy. If you don’t, discontinue use immediately.
4. Accounts and Access
Some features may require an account. If so, keep credentials confidential and ensure info is accurate. We may suspend or terminate access at our discretion for abuse, violations, or illegal activity.
5. User Content and Copyright
By submitting content, you confirm you own or have rights to it, it doesn’t infringe others’ rights, and all depicted persons are 18+ with consent.
You grant Fapaton a worldwide, perpetual, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, adapt, distribute, and display the content for operating and promoting the Service. To the extent allowed by law, you waive moral rights against Fapaton.
You grant other users a non-exclusive, royalty-free license to view your content through the Service as allowed by its features and these Terms.
We may retain server copies of removed content for backup, legal, or dispute purposes. We do not endorse user content and disclaim liability for it.
6. Adult Content, Risk, Disclaimer
You may see explicit or offensive material. You waive claims against Fapaton relating to such content. We ban content with minors, non-consent, exploitation, trafficking, bestiality, or other illegal material and may report it.
7. Prohibited Uses
You must not upload or access illegal content; any material involving minors or non-consent; content without rights/permissions; promote brands/products without written approval; use monetizing shorteners; disrupt the Service; or bypass security. Access may be revoked without notice for suspected abuse or violations.
8. IP and Copyright Complaints
Marks and other IP on the Service (excluding user content) belong to Fapaton or respective owners. We respond to valid infringement notices. Provide work identification, URL, proof of rights, and contact details; we may remove content and limit repeat infringers.
9. Third-Party Links and Services
Third-party sites/services are outside our control; we aren’t responsible for their content or policies. Use them at your own risk and review their terms and privacy practices.
10. Availability, Data Loss, Disclaimer
Service is provided “as is” and “as available.” We don’t guarantee uptime, accuracy, or suitability. We’re not liable for data loss (favorites, settings, user content) or financial damages; you use the Service at your own risk.
11. Limitation of Liability
To the maximum extent permitted by law, Fapaton and its affiliates are not liable for indirect, incidental, consequential, special, or punitive damages, or loss of profits, revenue, data, or goodwill. Where exclusions aren’t allowed, liability is limited to the extent permitted by law.
12. Indemnity
You agree to defend and indemnify Fapaton and its affiliates against claims, losses, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, submitted content, or infringement of third-party rights.
13. Termination
We may suspend or terminate access without notice for any reason, including violations, suspected illegality, or requests from authorities. Relevant sections (IP, disclaimers, indemnity, liability limits) survive termination.
14. Changes
We may modify these Terms; the “Last updated” date reflects the current version. Continued use after changes means acceptance. If you disagree, stop using the Service.
15. Governing Law
These Terms are governed by the laws of the jurisdiction where Fapaton is registered, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of those courts.
